Terms
These Terms and Conditions (“Terms”) govern the use of AskThai AI, an online Thai-language learning and question-answering service available at askthai.ai, including the German-language interface at askthai.ai/de/ (together, the “Service”). They apply between you and the provider identified in Section 2.
1. Scope
(1) By creating an account, subscribing to a paid plan, or otherwise using the Service, you (“user”, “you”) agree to these Terms. If you do not agree, please do not use the Service.
(2) These Terms apply to consumers and, where relevant, to business users. Provisions that apply only to consumers under mandatory law are identified as such.
(3) Any terms proposed by you that conflict with or supplement these Terms do not apply unless we agree to them in writing.
(4) Our Privacy Policy describes how we handle personal data and is incorporated by reference; it does not form part of the payment or service-delivery terms in this document.

Payments for paid subscriptions are processed by Stripe, Inc. (“Stripe”). We do not store full payment card numbers; Stripe’s own terms and privacy notices apply to the payment process.
3. Description of the Service
(1) AskThai AI helps users learn and understand Thai. Depending on the question and available modules, the Service may provide:
- AI-assisted answers to Thai-language questions,
- curated lexicon and classifier (word-category) information,
- GRADUS/Silko transliteration and pronunciation guidance,
- grammar notes, word-by-word breakdowns, and examples,
- optional audio pronunciation via text-to-speech (where configured, currently ElevenLabs),
- storage and display of submitted questions and generated answers,
- user accounts, a profile, and usage limits,
- an optional installable web-app experience,
- an optional invite/referral program.
(2) The user interface is available in English and German. Answer content may be produced in English or German depending on your settings.
(3) We may add, change, limit, or discontinue individual features at any time, including features offered on an experimental basis.
(4) AskThai AI is a language-learning aid. It does not provide legal, medical, financial, safety, travel, or other professional advice, and must not be relied on as such.
4. Registration and accounts
(1) Parts of the Service can be used without an account (“Guest” use), subject to usage limits. Creating a “Free” account (with a verified email address) and subscribing to “Pro” unlock higher limits and additional features; current limits and features are shown in the Service and on the relevant pages (e.g. /pro/) and are not fixed numbers in these Terms.
(2) To register, you must provide a valid email address and a password meeting our minimum requirements. You confirm that your registration details are accurate and that you are entitled to use the Service.
(3) We may require email verification before granting Free-tier limits; until verified, Guest-level limits apply.
(4) You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at hi@askthai.ai if you suspect unauthorized use.
(5) Minimum age: you must be at least 18 years old to enter into a paid subscription. Where permitted by law, minors may use free/guest features of the Service only with the consent of a parent or legal guardian where such consent is required.

5. Plans: Guest, Free, and Pro
(1) Guest: available without registration, subject to daily/weekly usage limits.
(2) Free: available after registration and email verification, with higher usage limits than Guest.
(3) Pro: a paid subscription purchased via Stripe Checkout, offering expanded usage limits and features as described on /pro/. Current limits, device allowances, and included features are shown in the Service and may be adjusted from time to time for reasons such as stability, security, cost, or abuse prevention; we will not reduce Pro’s core paid benefits without appropriate notice where required by law.
(4) We may apply automated fair-use and anti-abuse measures (e.g. device limits, rate limits) to all plans.
(5) We may offer an optional invite/referral program that credits eligible users for referring new users; where offered, its terms are shown in the Service. Referral tracking uses a cookie as described in our Privacy Policy.
6. Formation of the Pro contract
(1) Prices and plan descriptions shown on the Service are informational until confirmed at checkout.
(2) A Pro subscription contract is formed when you, while logged in, select a plan and currency on the /pro/ page, complete Stripe Checkout, and your payment is authorized. Access is activated once we receive confirmation from Stripe; brief delays are possible.
(3) By completing Checkout you confirm that you accept these Terms and, where applicable, acknowledge any early-performance/withdrawal notice presented in the checkout flow (see Section 10).
7. Prices, currencies, and payment
(1) Pro is offered as a recurring subscription, billed monthly or yearly, in EUR, USD, or THB as selected by you at checkout.
(2) Current prices are shown on the /pro/ page and confirmed in Stripe Checkout before you pay; the amount and currency shown at checkout are binding for that purchase. We do not display fixed prices in these Terms because prices, currencies, and any applicable tax treatment may be updated from time to time.
(3) Payment processing, invoices, and stored payment methods are handled by Stripe. You can manage your payment method and view invoices via the Stripe Customer Portal, accessible from your profile.
8. Term and renewal
Pro subscriptions renew automatically for the same billing period (monthly or yearly) unless cancelled before the renewal date. We do not offer a separate free trial unless one is expressly shown to you at checkout.
9. Cancellation
(1) You can cancel your Pro subscription at any time via “Manage plan” in your profile, which opens the Stripe Customer Portal.
(2) Cancellation takes effect at the end of the current billing period; you retain Pro access until then, and it is not renewed afterward. We do not provide partial refunds for the unused portion of a period on ordinary cancellation.
(3) If a payment fails and your subscription status becomes past due, we may revoke Pro access immediately, without a grace period, until payment is resolved.
(4) You may stop using Guest/Free features at any time simply by discontinuing use, or request account deletion as described in Section 4(6).
(5) We may suspend or terminate accounts for the reasons described in Section 22.
10. Right of withdrawal for consumers
(1) If you are a consumer entitled to a statutory right of withdrawal (cooling-off right) under the law applicable to you (for example, consumers in the EU/EEA), you may be able to withdraw from a paid contract within the applicable period without giving a reason. Full details, deadlines, and the model withdrawal form are set out below under “Withdrawal Information”.
(2) Because Pro provides access to digital content/services that typically begins immediately after payment, the right of withdrawal may end early if you expressly request that we begin providing the Service before the withdrawal period expires and you acknowledge that you thereby lose your right of withdrawal, in each case as presented during checkout where applicable.
(3) Your statutory rights are not affected by anything in this Section.
11. Usage limits and fair use
(1) Usage limits (e.g. questions per day/week, device counts) differ by plan and are shown in the Service; we may adjust them for stability, security, or abuse prevention.
(2) We use automated safeguards, which may include IP/network-based limits, device identifiers, and relevance checks, to detect and prevent abuse.
(3) You must not attempt to circumvent limits, for example through multiple accounts, automated bulk querying, or scraping.
12. Your obligations
You agree to: use the Service only for lawful, learning-related purposes; provide accurate registration information; keep your credentials secure; not interfere with or attack the Service (e.g. malware, exploits, denial-of-service); and comply with applicable law.
13. Prohibited uses
Without limiting Section 12, you must not: scrape or systematically extract lexicon, transliteration, or answer data; resell, sublicense, or rent access to the Service; use the Service to build a competing product through bulk extraction; submit unlawful, infringing, or harassing content; or manipulate referral, payment, or quota mechanisms. We may remove content, restrict access, suspend or terminate accounts, and pursue legal remedies for violations.
14. AI-generated content and accuracy
(1) Answers may combine AI-generated text with curated lexicon and rule-based data. AI outputs can be incorrect, incomplete, outdated, or culturally inaccurate.
(2) We do not warrant the linguistic, cultural, or factual accuracy of any answer, translation, or transcription.
(3) Underlying models, prompts, and answer quality may change over time without notice.
15. Your responsibility for using results
You must independently verify important information before relying on it, particularly for exams, professional use, legal or medical matters, or any safety-critical situation. Decisions you make based on the Service’s output are your own responsibility.
16. Our intellectual property
(1) All rights in the Service — including its software, design, the AskThai and GRADUS/Silko systems, our lexicon and rule data, and documentation — belong to us or our licensors.
(2) We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended personal, non-commercial learning purpose during your use of the Service.
(3) You may not use our trademarks, logos, or brand features without our prior written permission.
17. Rights in content you submit
(1) You retain any rights you have in the questions and other content you submit (“Input”), subject to applicable law.
(2) By submitting Input, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display your Input as needed to operate and provide the Service, including sending it to processors and third-party providers (such as AI/LLM and text-to-speech providers) strictly to generate your answer and operate the Service securely.
(3) We may use Input and derived, aggregated, or de-identified data for operating, securing, troubleshooting, and improving the Service (including error analysis and quality assurance). We do not grant AI providers a blanket license to use your Input to train their general-purpose models; any such use is governed by our contracts and configuration with those providers, which we may update from time to time.
18. Generated answers, public question pages, and use of outputs
(1) Subject to applicable law, you may use answers generated for you for your personal, non-commercial learning purposes.
(2) You must not mass-republish, scrape, or resell generated answers or our lexicon content as a standalone product without our permission.
(3) Questions and answers are typically published at a public URL (e.g. askthai.ai/q-{slug}/ or the German equivalent under /de/). New questions are generally not indexed by search engines by default (noindex) until they are marked as editorially suitable for indexing; indexable questions may also appear in “related”, “popular”, or “suggested” listings and in our sitemap. We do not display the asking user’s name or email address on the public answer page; however, we may still internally associate a question with an account, device, or log data for support, abuse prevention, and legal purposes. Do not submit passwords, financial details, health data, or other secrets or highly sensitive information in a question — assume questions may become publicly visible. If you find inappropriate or concerning public content, report it to hi@askthai.ai.
19. Privacy
Our Privacy Policy describes what personal data we process, why, and your rights, and applies in addition to these Terms.
20. Referral / affiliate program
Where we offer an invite or referral program, participation is optional and subject to the program terms shown in the Service (e.g. commission rates, cookie-based attribution, and payout thresholds). We may change or discontinue the program at any time. See our Privacy Policy for the related cookie.
21. Third-party services
Providing the Service may involve third-party providers, including Stripe (payments), one or more AI/LLM providers, ElevenLabs (text-to-speech, where configured), email delivery providers, Google Tag Manager and Google Analytics (analytics), Cloudflare (security/CDN, where used), and hosting providers. Their availability, terms, and policies may affect the Service.
22. Availability, changes, and suspension
(1) We aim for good availability but do not guarantee any specific uptime or service level.
(2) The Service may be interrupted by maintenance, outages, force majeure, or third-party failures.
(3) We may change, limit, or discontinue features; where a change materially reduces a paid feature you rely on, we will provide reasonable notice where required by law.
(4) We may suspend or terminate your access for material breach of these Terms, suspected abuse, security risks, non-payment, or as required by law.
23. Liability
(1) We are liable without limitation for intent and gross negligence, under applicable product-liability law, and for death, personal injury, or health damage caused by us.
(2) For ordinary negligence, we are liable only for breach of a material contractual obligation, and in that case limited to the loss that was foreseeable and typical for this type of service, to the extent permitted by law.
(3) Subject to paragraphs (1) and (2), we are not liable for the accuracy of AI-generated or lexicon-based content, for decisions you make based on it, or for outages or failures of third-party providers we do not control.
(4) Nothing in these Terms limits any liability that cannot be limited or excluded under mandatory consumer-protection law applicable to you.
24. Indemnification
To the extent permitted by law, you agree to indemnify and hold us harmless from third-party claims, damages, and reasonable defense costs arising from your unlawful use of the Service or unlawful content you submit, except where such claims arise from our breach of these Terms or applicable law. This section does not apply to the extent it would be unenforceable against consumers under mandatory law.
25. Changes to these Terms
We may update these Terms from time to time, for example to reflect legal requirements, new features, or security needs. We will notify you of material changes by email or an in-Service notice before they take effect. If you do not agree with a material change, you may cancel your subscription as described in Section 9; continued use of the Service after a change takes effect constitutes acceptance, to the extent permitted by law.
26. Governing law
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws principles. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence.
27. Venue
Subject to mandatory consumer-protection venue rules that may apply to you, any dispute arising from these Terms shall be subject to the non-exclusive jurisdiction of the state and federal courts located in Bernalillo County, New Mexico, USA.
28. Miscellaneous
(1) If any provision of these Terms is or becomes invalid, the remaining provisions remain in effect, and the invalid provision will be replaced by a valid one that most closely reflects its intended purpose, to the extent permitted by law.
(2) These Terms are published in English and German. The English version prevails in case of any conflict or inconsistency between the two versions.
(3) We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them without our consent.

30. Withdrawal Information
Withdrawal right
If you are a consumer located in a jurisdiction that grants a statutory right of withdrawal for distance contracts (such as the European Union or European Economic Area), the following applies to your paid subscription to AskThai AI.
You have the right to withdraw from your subscription contract within 14 days without giving any reason.
The withdrawal period expires 14 days after the day of the conclusion of the contract (i.e. the day your subscription payment is confirmed).

of your decision to withdraw from this contract by a clear statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you for the withdrawn subscription without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will use the same means of payment as you used for the initial transaction (typically via Stripe), unless expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested that the Service begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until the time you informed us of your withdrawal, compared with the full coverage of the contract.
Early performance and loss of the right of withdrawal
Because Pro provides immediate access to digital content and services, if you expressly request that we begin providing the Service before the end of the 14-day withdrawal period and you acknowledge that you thereby lose your right of withdrawal once the service has been fully performed, your right of withdrawal ends when performance is complete. This request and acknowledgment, where applicable, are presented to you during Stripe Checkout.
Ordinary cancellation
If your right of withdrawal has expired or does not apply, you can still cancel your Pro subscription at any time so that it does not renew, as described in Section 9 above and via the Stripe Customer Portal.
